This is a NEW one-day course geared to Human Resource positions only. This seminar allows all levels of HR to ensure that they are compliant with the rapidly evolving employment laws that impact the HR role and responsibilities. HR can be held individually liable for many of its functions, so continuing education is vital. This seminar will be a hands-on “how to” approach to training with scenarios, checklists, step by stop guides, sample letters and form. We will review mock situations for each topic to find the non-compliant areas and show how to correct them. Please join two employment lawyers with over 40 years of combined experience (with a little bit of humor) to help you learn and/or refresh on the following critical skills and processes:

 

Morning session: 9:00-10:30

 

Recruiting

    • External vs. internal posting
    • Job Descriptions – How to draft/revise them for defense of claims
    • Applications vs. Resumes – Legal risks and responsibilities
    • Interview Process – Illegal versus legal practices
    • Rejection letters and conversations – Do’s and Don’ts

Break: 10:30-10:45

 

Midmorning session: 10:45-12:00

 

Onboarding

    • Job Offers and compensation promises/structures
    • Sample and enforceable agreements/forms: Authorizations to deduct, signing bonuses, training advances, issuing equipment and more
    • Exemption classification – Number one wage and hour legal risk for HR
    • I-9s! – Mock documents to demonstrate compliance v. non-compliance
    • Background checks – Are you complying with federal law?

Lunch: 12:00-12:30

 

Afternoon Session: 12:30-2:00

 

Documentation – How to do it and/or how to correct manager’s documentation

    • Several mock documents demonstrating legally problematic documentation, coaching and warnings. Steps on how to correct documentation to bolster legal protections
    • Performance Reviews – The good, the bad, the ugly
    • Termination documentation review and mock scenarios

 

Break: 2:00-2:15

 

Late Afternoon session: 2:15-4:00

 

Managing Employee’s Leaves and Accommodation Requests – ADA/FMLA/Non-FMLA, Bereavement, Jury Duty, Parental Leave

  • Checklists, conversation scripts, sample letters – Practical guide for each conversation and step that HR needs to take in administering these legally fraught leaves and accommodation requests including fitness for duty, legally mandated forms, return to duty, modifications.
  • Additional issues relating to parental leave, donated leave, jury duty and other non-medical leaves, suspected leave abuse or fraud
